This initiative seeks to rectify the long-standing exclusion of Cost and Management Accountants (CMAs) from the definition of "Accountants," which has unfairly restricted their professional practice in taxation and financial reporting. Rationale for Inclusion 1. Competence and Expertise: CMAs undergo rigorous training in costing, taxation, financial reporting, and auditing, making them well-qualified to certify financial statements and tax returns. 2. Global Best Practices: Many countries, including the United Kingdom, Canada, and Australia, recognize cost accountants as professional accountants. India must align with global standards. 3. Bridging the Professional Gap: Excluding CMAs from the definition of "Accountants" limits businesses from leveraging their expertise, leading to unnecessary dependence on a single professional body. 4. Strengthening Tax Compliance: Cost Accountants play a crucial role in cost audits, transfer pricing, and indirect taxation. Their inclusion will enhance tax compliance, reduce tax evasion, and improve financial transparency. Demand for Legislative Amendment I along with my professional colleagues , urges the Hon'ble Members of Parliament to amend Section 515(3)(b) of the proposed Income Tax Act, 2025, by explicitly including Cost Accountants in the definition of "Accountants." This recognition will ensure a level playing field and empower CMAs to contribute effectively to the nation’s financial ecosystem. The exclusion of Cost Accountants is a matter of professional injustice, and I strongly seek parliamentary intervention to correct this anomaly. |

CMA ANIRUDDH GUPTA | Member | Ujjain (MP) | The New Income Tax Bill 2025 was introduced in the Lok Sabha on 13th February 2025. The purpose of this bill is to simplify the complex Income Tax Act of 1961. The primary objective mentioned by the Minister is to reduce disputes / litigation involving the tax system and bring Ease of Compliance. ICMAI as well as ICSI have represented their inclusion quoting industries and businesses will require more qualified professionals for taxation and compliance purpose preventing dependency on any single profession and ensuring a competitive, quality-driven tax ecosystem. Lets look what could be points which may be relevant for such inclusion of CMAs for Income Tax Audits, are - 1. ICMAI is recognised an accounting body formed by Act of Parliament. It’s affiliated to IFAC (International Federation of Accountants), CAPA, SAFA. Further Cost Accountants are authorized to be an Auditor as per definition in section 2 of CWA Act. 2. Curriculum of CMA extensive coverage of Income Tax Law at the Intermediate Stage in PAPER 7: Direct and Indirect Taxation (DITX) & at Final Stage PAPER 15: Direct Tax Laws and International Taxation (DIT). 3. Strengthening MSME Tax Governance - MSMEs often lack structured tax compliance due to limited resources. CMAs, with their experience in cost management and financial structuring, can help optimize tax liability while ensuring full compliance, benefiting small businesses and increasing tax revenues. 4. Recognition as at par under all other Statutes- – Goods and Services Tax [GST] – Companies Act as an Internal Auditor (sec 138) – Co-operatives Societies Act in States like Karnataka, Maharashtra, HP, West Bengal – Tax Return Preparer (Amendment) Scheme, 2018 – Erstwhile Central Excise Act & Service Tax Act – Income Tax Act as Authorised representative & Audit of Inventory Valuation (Sec 142 A) – CMAs are recognized by statutory bodies for professional services in RBI, IRDAI, SEBI, IBA, MCA, IBBI, CCI, NPPA, TRAI, CERC, IFSCA, NABARD, NSDL, Ministry of Agriculture, Ministry of Commerce and Industry, Ministry of Textiles and many others. 5. Strengthening Transfer Pricing & International Taxation - CMAs are already involved in transfer pricing documentation and cost analysis for international transactions. Their inclusion in tax audits would enhance accuracy in cross-border tax compliance, preventing tax base erosion and profit shifting (BEPS). 6. Industry-Specific Tax Audit Insights - Since CMAs conduct cost audits in regulated industries (such as pharmaceuticals, infrastructure, and manufacturing), they have deep insights into sectoral taxation. Their inclusion in tax audits would ensure a more informed approach to sector-specific tax policies. 7. Expertise in Cost & Financial Analysis - CMAs have deep expertise in cost structures, cost allocations, and financial analysis, making them well-equipped to assess financial statements accurately in an Income Tax Audit. They can ensure proper disclosure and classification of expenses, reducing tax leakages. 8. ICMAI has a disciplinary mechanism in place which is required to keep check on the auditing professionals. Further, it has prescribed code of conduct, Peer review mechanism as well Quality Review Board (QRB) to ensure quality auditing services are rendered by its members. 9. Recommendation by the Parliamentary Committee to include Cost Accountants in the definition of ‘accountant’ in its 49th Report of 15th Lok Sabha, relating to “The Direct Taxes Code Bill, 2010” as well as in “DTC, 2013” & again in 122nd Report of the Department Related Parliamentary Standing Committee on Commerce on Ease of Doing Business dated 21st December, 2015. 10. Allowing CMA would ensure healthy competition which is very much required in open economy. It will definitely benefit the tax administration system as well as the assesses, especially the MSME assesses. 11. CMA with their techno commercial skills will be able to provide value added auditing services apart from regular compliances checks which may bring more effectiveness in Tax administration system. Further, increased availability of professionals will ensure timely compliances, avoiding extensions, & competitive pricing of auditing services which will be benefiting both Tax Administration as well as Taxpayers. Our Prime Minister Narendra Modi ji has set up target of 5 trillion economy by 2025 and robust tax mechanism would play vital role in ensuring we achieve it. His vision of Viksit Bharat 2047 would mean inclusive growth for everyone not limiting to certain class. CMA professionals would definitely be an active participant in achieving the milestones set up by our leadership. As we always say its TEAM (Together Each Will Achieve More) effort. In order to encourage fair competition and in public interest such inclusion of CMAs are paramount for the growth of the nation. Mohammed Khalfan | Student | Malappuram / Kerala | With due respect, we, the members, students and supporters of the Cost and Management Accounting (CMA) profession, express our deep concern regarding the discriminatory provision in the New Tax Bill 2025, which restricts tax audit rights exclusively to Chartered Accountants (CAs), thereby excluding Cost and Management Accountants (CMAs). This exclusion is unjust and illogical, as both CAs and CMAs undergo rigorous professional training, study nearly identical subjects in taxation, auditing, financial management, and compliance, and contribute significantly to financial governance in India. CMAs are already recognized under various laws, including the GST Act, for certifying tax-related matters. However, denying CMAs the right to conduct tax audits not only undermines their professional capabilities but also creates an unfair monopoly, limiting opportunities for skilled professionals and increasing dependency on a single profession. Granting tax audit rights to CMAs will: Enhance Efficiency – Expanding the pool of qualified professionals will ease the burden on taxpayers and businesses. Promote Fair Competition – A level playing field will improve the quality of tax audits and reduce professional monopolization. Ensure Compliance & Transparency – CMAs, with their cost audit expertise, can strengthen tax compliance and revenue accuracy. In a country striving for financial inclusion and professional equality, such exclusionary policies hinder progress. We urge the government to reconsider and amend the bill, ensuring that CMAs receive their rightful tax audit privileges, just as in global economies where Cost and Management Accountants have equal rights in financial auditing and taxation. We request you to uphold the principles of fairness, merit, and professional equality by granting CMAs the rightful recognition they deserve. |
