Here are the key reasons why CMAs should be included in the definition of "Accountant" in the proposed Income Tax bill 2025.

1.Equivalent taxation knowledge-: CMAs and CAs undergo the same level of taxation curriculum during their studies, covering Income Tax, GST, Transfer Pricing, and Tax Audit etc.

2.Government recognized tax work-: CMAs are already authorized to conduct GST Audits, Valuation under the Companies Act, and Special Audits under the Income Tax Act

3.Preventing monopoly & ensuring fair competition-: restricting taxation practice to only one professional body creates a monopoly, limiting taxpayer access to expert services and increasing compliance costs.

4.Contribution to Policy & Compliance-: CMAs have played a key role in GST implementation, tax planning, and compliance frameworks. Their expertise in cost management enhances tax efficiency for businesses.

Excluding CMAs from the definition of "Accountant" under the Income Tax bill 2025 is not justified on competency grounds.Based on their recognized taxation expertise and contribution to tax compliance "Cost Accountants" must be included in the definition of "Accountant"to ensure fair opportunities and better tax services for businesses.

Biswanath Mohapatra Member Nayagarh, Odisha Your statement is far away from legal, constitutional and your technical education since the year 1949 where lies your scope in every Act where there is no two provision for CA and CMa. It seems to be a representation which is a trite having no benefit u/a 14 of the Constitution. Why you are not demanding such provision when CAs included in Central excise Act in the year 2010 or in second provision of sec 44AB of Income tax act followed by Gst act in the year 2016. The reason behind these is the discrimination violating article 14 and 19(1) (g) of the constion. Legal advice to get it: 1- sec 31 of ca act original making it a temporary provision awaiting Icwa act 2-The purpose of icwa for a check against human factors involved in a CA under the Evidence Act vide sec. 114 3-As Ca Act is a preconstitutional Act, it canot enter in to the field of ICWA act vide article 13(1) of the constitution4- financial accounting is primary and cost accounting is Ancilary for CA where as cost and management accounting is primary and financial accounting is primary. Full effect will be given to ancilary in a single statute having no two provisons for both as per article 14 and 19(1) (g) and also nine member bench judgment of Apex Court with one dissenting judgment in respect of ancillary education 6- As the fiscal statutes should be constued strictly, both Ca and CMA are complete accontant not being the fact that the term financial accounting is always referred to the accounting and the person is accountant. So, it is not a strict construction and tax audit for CA is compensation for audit of accounts of political parties and companies to hide prper sale after break even point. If there is no reconciliation statement, there is no requirement of income tax audit because citizens are competent to file the figures in return. This reconciliation statement influences citizens decision making under article 19(a) of the Constitution whether to retain share or dispose. So, reconciliation statement followed by the cah flow statemrnt is a check against chartered accountant by a cost accountant for the authentication of audited profit and loss accountant and balance sheet. 8- straight jacket principle of accountant can not be maintained for which check at joints should be there. 9- you can see one type of balance sheet and profit and loss account for production, processin etc in text book of financial accounting and another set of profit and account and balance sheet in the text book of cost accounting. What does it mean constitutional application? This is the geographical location of accountants. One for trading and financial concerns I. E. CA and another for production, processing, services etc concerns I. E. CMA. So supreme Court deemed to be golden rule of Apex Court. Refer also AIR 1958 SC 538 for the inefficiency promoting black money, loss to share holders clauses of enquiry in spite of financial audit and also the golden rule of article 14 including geographical location
