I would like to bring to your attention a long-pending issue regarding the definition of “Accountant.” As per Clause 2, only Chartered Accountants are eligible, which contradicts the government’s earlier intent, particularly since Hon’ble Prime Minister Shri Narendra Modi Ji assumed office 11 years ago. The guiding principle has always been that, apart from three designated audits—Statutory Audit by Chartered Accountants, Cost Audit by Cost Accountants, and Secretarial Audit by Company Secretaries—all other taxation-related assignments should be open to professionals from any of the three institutes. This amendment is crucial – 1. It is also predominant to mention here that in earlier DTC proposals the recommendations by the standing committee it was proposed to widen the scope for inclusion of Cost Accountant / Company Secretary in the definition of Accountant. 2. To prevent monopolistic and restrictive practices, which often lead to inefficiency, complacency, and corruption. |

Background: The current definition of 'accountant' under the Income Tax Act restricts the eligibility to Chartered Accountants (CAs) for conducting tax audits and related attest functions. This exclusivity has been a subject of extensive debate, especially considering the evolving dynamics of the accounting profession and the diverse expertise offered by various accounting professionals. Our Position: 1. Equitable Recognition of Professional Bodies: Statutory Recognition: ICMAI, like the Institute of Chartered Accountants of India (ICAI), is a statutory body constituted under an Act of Parliament. Our members undergo rigorous training and possess specialized knowledge in cost and management accounting, equipping them with the necessary skills to perform tax audits with utmost proficiency. Global Practices: Internationally, various jurisdictions recognize multiple accounting professionals for audit and attest functions. For instance, in the United States, Certified Public Accountants (CPAs) and Certified Management Accountants (CMAs) are authorized to perform a range of audit services. Aligning with such global practices would enhance the credibility and inclusivity of our tax administration system. 2. Preventing Professional Monopoly: Diverse Expertise: The inclusion of Cost Accountants in the ambit of 'accountant' would leverage their expertise in cost analysis, financial management, and performance evaluation, thereby enriching the quality of tax audits. Competitive Environment: Allowing only one category of professionals to conduct tax audits fosters a monopolistic environment, which can stifle innovation and efficiency.
