Pavan Kumar Nerella | Member | NELLORE | Subject: Advocacy for Inclusion of Cost Accountants in the Definition of "Accountant" under the Income Tax Act, 2025 Respected Madam, I write to express my unequivocal support for the representation submitted by the All India Cost & Management Accountants Association (AICMAA), advocating for the inclusion of Cost Accountants within the definition of "Accountant" under Section 515(3)(b) of the proposed Income Tax Act, 2025. As a Cost and Management Accountant (CMA) with extensive experience in financial management, taxation, and compliance, I firmly believe that the exclusion of CMAs from this definition is inconsistent with the principles of professional equity and the broader objectives of economic governance. The role of Cost Accountants in taxation, financial reporting, and regulatory compliance is well established, and their contribution to ensuring fiscal discipline and minimizing revenue leakage is undeniable. Rationale for Inclusion of Cost Accountants 1. Recognized Expertise in Taxation and Compliance Cost Accountants are already empowered to conduct audits under the GST Act, 2017, internal audits under the Companies Act, 2013, and inventory valuations under Section 142(2A) of the Income Tax Act, 1961. The exclusion of CMAs from conducting tax audits under Section 44AB of the Income Tax Act lacks a justifiable basis and creates an unnecessary restriction on a profession statutorily established under the Cost Accountants Act, 1959. 2. Endorsement from Parliamentary Committees and Precedents The 49th and 122nd Reports of the Parliamentary Standing Committees on Finance and Commerce have explicitly recommended the expansion of the definition of "Accountant" to include Cost Accountants. The Direct Tax Code (2013) also acknowledged the need for the inclusion of CMAs, demonstrating a well-founded precedent for this amendment. 3. Improving Audit Quality and Enhancing Tax Compliance The Comptroller and Auditor General (CAG) Report (2014) highlighted substantial revenue leakages due to errors in tax audit reports, reinforcing the need for diversified professional participation. Expanding the scope of tax audits to include Cost Accountants will strengthen tax compliance, improve audit quality, and ensure a broader talent pool for professional scrutiny. 4. Alignment with Global Best Practices and Economic Vision Internationally, all professionally qualified accountants, including management accountants, are recognized as integral to tax compliance and audit functions. The Government’s vision of ‘Viksit Bharat 2047’ necessitates the removal of restrictive barriers that hinder professional parity and limit contributions to the nation’s economic and fiscal ecosystem. Request for Consideration Given the above, I earnestly urge the Government to amend Section 515(3)(b) of the proposed Income Tax Act, 2025, to explicitly recognize Cost Accountants within the definition of "Accountant". Doing so will not only rectify an existing professional disparity but also promote a more competitive and transparent tax administration framework. I trust that under your esteemed leadership, a balanced and equitable policy decision will be undertaken in the larger interest of strengthening India’s financial, regulatory, and taxation systems.
